The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company's terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of Belgium. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Our products are fully digital. For MyBB Plugins access, if there are no server failures, access is usually granted within a few minutes of purchase confirmation. However, we reserve the right to grant access to the digital products later than this in the event of technical issues. As by law, we have a maximum of 30 days to grant access to the digital goods.
In case no access was granted to the products after purchase, please contact us at contact@createmytech.com in order to resolve this issue. We will do our best to resolve this as soon as possible
Our products are protected through our licensing server. Beginner and essential pack customers can use the plugins on one MyBB forum max. Royal pack customers can use the plugins on three MyBB forums max.
The licenses need to be manually added by the customer in the customer download area, my licenses. There, the customer can input the valid URL to their MyBB forums. Once activated, the plugins can be installed on their forum. License URLs can only be changed once per month in order to avoid abuse. For more changes, please contact us.
As written in the previous subchapter, Product Licensing, the products are protected by a digital licensing server. In order to activate or deactivate the products, the products will have a short data transfer with the CreateMyTech systems during usage. We do not collect statistics on purpose for these data transfers, these are purely for license activation and anonymous. By using our products, you allow our products to contact CreateMyTech systems purely for the purpose of license validation.
We reserve the right to suspend, deactivate and remove all licenses from your account if we suspect abuse of any forms. If we notice very frequent license changes which might be suspected as abuse, we may terminate your account without notice.
For the case of support products (extra purchased support, not included in membership), after purchase please contact us in order to make an appointment. This appointment needs to be made within 30 days of the payment.
In case the buyer does not show up, or shows up late to an appointment, the buyer can reschedule one more time. If the buyer again does not show up or shows up late to the second appointment, the support request is cancelled and the item will be refunded, however a service charge of 20% will be charged and removed from the refunded amount.
We provide our digital products AS IS. For more details, please refer to our End User License Agreement. By purchasing products from us, you also agree with our End User License Agreement. In the event you would not agree, please do not purchase our products. We will do our best to provide solutions in case a technical issue occurs due to our software on a brand new MyBB forum installation. We do not have a deadline for providing this solution and are not obliged to solve this issue. In case of conflicts between multiple third-party plug-ins, we cannot guarantee support. In case of technical issues with one of our plugins, please always let us know, as we will do our best to find a solution.
For support products, we guarantee at least the amount of time purchased for support will be used to provide live support. Please bear in mind that you will need to use the allotted time within one appointment. In case the user ends the appointment early, the support product is ended as is and no refund will be provided. We will do our best to solve your issues. However, while we guarantee support for a specific time, we do not guarantee that your issues will be resolved, as this would depend on the specific support time purchased by the customer. Please discuss this beforehand in case this is a concern.
Due to the nature of our products (digital), we cannot process refunds. During purchase you explicitly agree to withdraw your right to refund the access to the digital products. In some specific cases we might be able to help you process a refund, but please contact us at contact@createmytech.com in order to know more about this. One of the conditions for refunding is that no products were downloaded from your user account after purchase of the membership. In the case of support, if no appointments were taken successfully, a refund can be provided. In case the customer missed the appointments, a 20% refund charge will be removed from the total refunded amount.
1. Payment Gateways Payments are only accepted through the payment gateway PayPal. Unless there is an explicit written agreement on using another payment gateway for your transaction, no other payment gateway will be accepted.
2. Deposits For some CreateMyTech transactions, deposits are required. These payment deposits need to be paid before CreateMyTech will start the requested works in order to avoid non-payment of customers. These deposits are non-refundable, unless there is an explicit written agreement on refunding the deposit from CreateMyTech. These deposits are only a percentage of the total price. In order to receive the completed work item, the final payment needs to be successfully transferred to CreateMyTech. Upon receival, CreateMyTech will send the completed work item to the customer.
3. Payment Deadlines Payments need to be successfully completed within 7 days since the invoice was sent to the customer. In the cases of non-payment or late payment, payment fees can be requested as explained in article 4 of our payments terms and conditions.
4. Late Payments In case of late payment, the customer will incur a late payment fee of 50.00 EUR, as well as an added interest rate of 10% per year.
